Bangalore Policemen, Too, Draw A Blank; Supreme Court Asks CBI To Track Her Down
New Delhi: A seven-year-old US-born boy was allegedly abducted from New York to India by his mother in 2007 in violation of local court orders. Since then, the mother has dodged the police of four states forcing the Supreme Court to seek the CBI’s help.
“It is abundantly clear that despite best efforts made by police officers and officials of different states such as SSPs of Agra and Chandigarh and DGPs of Karnataka and Tamil Nadu as well as Commissioner of Police, Bangalore, the minor child Adithya and his mother Vijayshree Voora could not be traced and their whereabouts could not be found,”said a Bench comprising Justices Tarun Chatterjee and R M Lodha on Friday.
“It is almost two years since the notice was issued by the Supreme Court but the child could not be produced. Vijayshree is said to be mentally unstable and running around with the child from one state to another. In the peculiar and extraordinary circumstances, as as the present one, we are of the view that CBI may be assigned the task of tracing the minor and his production before this court,” it said driven more by the concern for the safety of the child.
And it conferred all powers on the CBI sleuth who would be nominated by the CBI director and assigned the task to trace the child. “He will enjoy all thepowers of a police officer carrying out search and issue non-bailable warrants, if necessary, and pick up the minor wherever he is found without interference from anyone and to produce him before this court,” the Bench said.
The father approached the New York family court accusing the child’s mother of violating the earlier court orders. On August 16, 2007, the family court granted sole legal and physical custody of the child to the father. Later, the New York Family Court issued child abuse non-bailable warrants against Vijayshree.
When things failed to fetch him his son, the father moved the SC in India in September 2007 seeking a writ of habeas corpus for the production of his minor son alleging that he has been illegally and unlawfully detained beyond his motherland, that is USA, in blatant violation of the orders of US courts.
Dr V Ravi Chandran married Vijayshree on December 14, 2000 at Tirupati
Adithya was born on July 1, 2002, in US
Due to matrimonial discord, Vijayshree moved the New York SC in July 2003 seeking divorce
September 8, 2005: Marriage was dissolved by New York court, and joint custody of the child was granted to the separated parents
June 28, 2007: Mother brought the child to India informing the father that she was going to reside with her parents in Chennai
