MUMBAI: The 12-year-old Saki Naka rape victim's aunt, Jyotsna Bapat, who took an exemplary stand against her son, has asked the police not to "let him go", but officials say they don't know if "these sentiments will be there forever".

The girl's parents chose not to come to Mumbai with her when she returned to press charges against her rapists, officials said. The parents stayed together in the city till 2005, after which they got divorced and went back to Gujarat. There, they got married again to different partners recently.

"The girl's mother met her when her aunt, Jyotsna Bapat, took her to Bhuj early this month after learning about what was going on. But the mother did not even bother to accompany her back to Mumbai when the Gujarat cops escorted her and her aunt back to file a complaint with us," an officer said.

The girl has apparently not met her father for the last five years. "She was nine months old when she was brought to Mumbai and was brought up by her aunt. It seems the aunt's son got emboldened when the girl's parents got divorced and then never came back," the officer said, adding that the girl hardly talked of her parents to the police. "She is much closer to the aunt," he said.

Officials say the 12-year-old rape victim and her aunt have been kept at an undisclosed place in the city.

The Bapats' family home at Subhash Nagar in Asalfa Village, Saki Naka, has been locked for the past three days.

Security cover has been given to the girl and her aunt, and this will continue till the cops smoke out the five absconding accused, including the victim's cousin, Dhaval.

Saki Naka senior police inspector S R Dhanedhar declined to comment on the whereabouts of the girl and her aunt but said the police had taken precautionary measures till the five absconders were held.

Investigators say the MMS clip recorded on Dhaval's mobile phone will help them wrap up the case. "His phone will be sent to the Central Forensic Science Laboratory in Kalina to verify the content," an investigator said

BANGALORE: Former Chief Justice of Punjab and Haryana High Court and BJP MP Rama Jois has said that Indian scriptures bar premarital sex and Indian society still consider pre-marital sexual relationship not good.

Jois, also a former Governor, in a statement said "the oral observations made by one of the judges of the three-judge bench of the Supreme Court in the context of male and female having sexual intercourse prior to marraige and question posed by the learned judge Who says it is bad? has given rise to counter question: who says it is good".

Quoting from scriptures, he said one of the nine directives of dharma prescribed by Mahabharata was "Prajanseveshu dareshu" one should procure children only under wedlock which by necessary implication bars pre-marital sexual activity between man and woman, he said.

"The object and purpose of marriage as declared by the Dharmasastras was not merely to satisfy the mutual carnal desire of man and a woman, though it did constitute the basis of the desire for marriage", he said.

Jois also refers to various Indian scriptures that upholds fidelity between spouses, mutual trust and discourages the `discarding attitude' of a spouse to pursue other gains.

ISLAMABAD: A Hindu priest committed suicide after killing his three minor daughters, all under 6-year-old, to please Hindu goddess Kali Mata in Bhemomal area of Sind province on Tuesday. According to police and eyewitnesses, religious rituals were regularly performed at the Kali Mata Temple established on the first floor of a house owned by Tekam Das Meghwar in Bhemomal. Reports say that Tekam Das Meghwar first slaughtered his three daughters, Parwati, 6-year-old, Reena, 4, and Aarti, 1, with a sharp knife and then slit his own throat to make Kali Mata happy.

Moulchand, brother of deceased Tekam Das Meghwar said, “My deceased brother was Hindu priest of Kali Mata and he performed pooja the whole night but in the early morning when power supply failed he slaughtered his three daughters before committing suicide with a sharp weapon.”

SHO Taluka police Rasool Bux Thaheem told media that after post mortem the bodies of the three sisters and their father were handed over to their heirs.

Initial police investigation suggested that Tekam Das Meghwar, early on Tuesday morning, entered the residential portion of the house, asking his wife, Pavi, to bring milk from a nearby shop. Investigators believe that taking advantage of solitary Tekam Das slit throats of his three daughters.

The ill-fated mother told police that "when I returned home, I saw heads of three girls in a cradle placed in room. Body of Tekam Das also lay in a pool of blood with his throat slit." She started screaming on which neighbours rushed to the house.

Another Hindu priest Bhagat Ashok told media that act of Tekam Das was foolish and it was illegal to offer sacrifice of even animals in Hindu religion. The incident spread panic in the town of Mirwah Gorchani as hundreds of people gathered at the spot.

MUMBAI: A 12-year-old girl, living with her aunt's family in Mumbai after her parents divorced and married other partners in Gujarat, was raped repeatedly for about one-and-a-half years by one of her cousins and his friends and neighbours.

The first time she was raped was in August 2008 and the ordeal stopped only a few days ago after an elderly person in the family came to know of what was happening from neighbourhood gossip. The culprits, including a 71-year-old man from the Saki Naka locality, made use of an MMS clip — of one of the assaults committed some time in 2008 — to blackmail the girl until the family elders came to know of what had been happening.

Four persons, including the 71-year-old man, have been arrested as cops are looking for the five other culprits including the girl's cousin, Daval Bapat.

The girl has been staying in Mumbai since she was nine months old. Her parents, however, divorced in 2005 and returned to their Gujarat hometown in Bhuj district where both remarried a couple of months back. She was left in the care of her aunt (mother's sister), Jyotsna Bapat, who stays with her younger son, Daval (24), and husband; her elder son had moved to Dubai some years back.

It was in August 2008 that Daval first raped the girl, who was studying in class VI at that time, at home after threatening her at knifepoint. The ordeal had just begun — Daval would rape her whenever his parents were not there. Later, in the same month, Daval and his friend, Raju Sharma, took her to a lodge in Kurla where they raped her. It was that day that both also made an MMS clip of their perversion.

Gradually, seven other neighbours became part of the gang that would just pick her up when they felt like it.
This went on till this month, when an elderly relative (Jyotsna's uncle) came to know of the horror. He immediately told Jyotsna and advised her to take the girl away to her maternal uncle's place in Bhuj.

No one there was, however, told of the reason for the girl's sudden transportation to Bhuj and things would have stayed like that if one of the accused, Raju, had not had the temerity of calling her up on Jyotsna's mobile phone. "You come back or your aunt will face the consequences," he threatened her. The girl could not take it any more; she broke down, leading to the unfolding of the horror tale.

When Cynthia Shackelford's marriage fell apart, it wasn't her husband she dragged into court.
Using a little-known American law, she sued his mistress for stealing him away.
The lawsuit did not win back her cheating husband, but it did give her a measure of revenge after a jury ordered the mistress to pay her the equivalent of £6million.
Mrs Shackelford, 60, said she gave up her teaching career to raise the couple's two children and support 62-year-old husband Allan's legal career.
And she insisted they were still in love when 49-year-old college administrator Anne Lundquist came along.
'I really loved him and I really thought he loved me,' she said. I had not a clue that Allan would wander. He kept telling me, "Oh, she's just a friend. There's no affair. I love you".'
In her lawsuit, the jilted wife also claimed her husband began having the affair before they separated in 2005.
Following a two-day trial in Greensboro, North Carolina, the jury sided with Mrs Shackelford, making the state's highest award for alienation of affection, criminal conversation - legal jargon for adultery - and intentionally or recklessly causing severe emotional distress.
North Carolina remains one of a handful of states which allow married partners to sue someone they believe is responsible for wrecking a marriage.
Mrs Shackelford said her husband met Miss Lundquist while providing legal services for the local Guildford College private school.
She said: 'We would like for people to respect the sanctity of marriage. We wanted a number high enough that it would keep other people from going after married spouses.'
Miss Lundquist said she planned to appeal against the 'ludicrous' judgment.
She lives with Mr Shackelford in Aurora, New York, but insisted the couple met after his marriage had ended. She said: 'The decision is not based on reality. I certainly don't have that kind of money nor will I ever.'
Miss Lundquist, now dean of students at Wells College in Aurora, said she was not given enough notice to prepare for the hearing and was not represented.
'I'm so caught off guard by everything,' she added, saying that finding that kind of money was 'hysterical'.
Although the Shackelfords separated five years ago, their divorce has not been finalised. More than 200 'alienation of affection' cases are filed in North Carolina each year.
The legislation existed in many U.S. states in the late 19th and early 20th centuries, but has been abolished in all but North Carolina, Hawaii, Illinois, Mississippi, New Mexico and Utah.
Although action does not require proof of extramarital sex, the wronged spouse must show that a love in a marriage was alienated and destroyed by the defendant's 'malicious conduct'.
Mrs Shackelford's lawyer, Will Jordan, admitted that securing the full £6million would be difficult.
But he said: 'I'm hoping we'll collect a substantial sum.
'In addition to just collecting the judgment, there's a certain amount of validation or vindication that goes with having a jury acknowledge that you were done wrong.'

She lives in a brightly painted house in a tiny hamlet which the Austrian media, when they mention it at all, refer to as "Village X". The two-storey family home is kept under constant CCTV surveillance, and any strangers caught lurking nearby can expect to be picked up by the police within minutes.

The concern about security, above all the fear of an all-pervasive, ruthlessly prying media does not end there. In addition to security guards, the citizens of "Village X" have formed a sort of Dad's Army to keep journalists and other sensation seekers at bay. "There are only a few villagers and they are all in with the police," recalled a photographer who was unfortunate enough to be sent on a mission to "Village X" last month. "I was quickly surrounded by people who told me: they don't want to talk to you, they don't want to see you – please get out of here," he said.

A family fortress in a village whose name can never be mentioned is the home Elisabeth's Fritzl today shares with her children. Except nobody calls her Fritzl anymore. She has been given a new identity. She is 44, but the only photographs of her ever published show her aged 16 and under. "Village X" is only a few kilometres away from the almost inadequately named "House of Horror" across the Danube in the nearby Lower Austrian town of Amstetten. It was at Amstetten's Ybbsstrasse number 4 that Elisabeth Fritzl spent 24 years of her life being held like a caged animal in an underground cellar where she was raped an estimated 3,000 times by her father, "Incest Monster" Josef Fritzl.

In that dank subterranean warren, Elisabeth bore Fritzl seven children without any medical help whatsoever. Three of them were sent "upstairs" as small children and lived comparatively normal lives being looked after by Fritzl's unwitting wife, Rosemarie. She had been duped into thinking that Elisabeth had run away from home to join a religious sect and had only returned to dump her newly born children on her mother's doorstep. Incredible as it seems, the Austrian social services believed the story. But the other four children Fritzl fathered through his incestuous relationship were never allowed to leave the cellar. One of them, a baby boy, suffered severe breathing problems after birth, so Fritzl let the child die rather than call a doctor because he was afraid of being found out. He burned the infant's body in a wood-burning stove.

Elisabeth Fritzl's ordeal defies adequate description. Two years ago she finally managed to escape the underground prison where, for almost a quarter of a century, she had lived alone and then shared with her three "cellar children", Kerstin, Stefan and Felix, then aged 19, 17 and five. A year ago last week, Josef Fritzl, then 73, was tried in a court in the Austrian city of Sankt Pölten where a jury found him guilty of mass rape, incest, wrongful imprisonment, coercion and murder by negligence. Dr Adelheid Kästner, the psychiatrist who interviewed Fritzl extensively before the trial, concluded that his terrible experiences as a child at the hands of a brutal and unloving mother had driven him to want to "control somebody completely." That "somebody" turned out to be his daughter Elisabeth whom he kidnapped and imprisoned in a cellar and began raping when she was 18, although the abuse started when she was just 11. The court sentenced Fritzl to life imprisonment. He is now held in a special facility for "mentally abnormal criminals" at Austria's Stein prison.

For the outside world, the first tangible signs of a return to something approaching a normal life occurred in late 2008 after Elisabeth and her children were deemed sufficiently recovered to be given a new home in "Village X". By July last year Elisabeth had struck up a relationship with Thomas Wagner, a security guard with the Austrian firm A&T securities. He is 23 years younger than her. Wagner was assigned to the family shortly after the move to ensure their safety. "It may seem remarkable but they are still together," said a source close to the medical team that monitors the family. "Thomas has become a big brother to the children," she added. Elisabeth is reported to have radically scaled back the therapy she undergoes for post-traumatic stress disorders as her relationship with Wagner has progressed. The three "upstairs" children's contacts with her and their "downstairs" brothers and sister have also gradually increased.

Last month, the near perpetual news blackout imposed by Elisabeth on herself and her family was broken by Josef Fritzl's sister-in-law, a woman who chooses to identify herself only as Christine R. Her description of Elisabeth's everyday life two years on from her escape revealed that it was astonishingly normal.

"Elisabeth likes to go shopping a lot," Christine R said, "She couldn't do that while she was locked in the cellar for those 24 years. She loves jeans with glitter pockets and she passed her driving test without difficulty. Now she's looking for a car. The kids are all going to school and working hard," she added. Christine R said Elisabeth was without any financial worries because the Austrian authorities had provided her with the €60,000 (£54,000) in child allowance that she was denied during her time in the cellar. "Felix, the smallest one, has got a PlayStation," she added.

Such a life was unimaginable in the spring of 2008 when Elisabeth escaped from her underground prison, her skin ashen coloured because of decades without sunlight and a diet of cheap supermarket food. She was placed with her three "cellar children" under the care of a battery of social workers, therapists and psychiatrists at a clinic outside Amstetten where she lived in hospital rooms overlooking trees and a wide lawn.

Felix was reported to have spent much of his time stroking the grass on the lawn in sheer wonderment. "For them a passing cloud is a phenomenon," remarked Berthold Kepplinger, the clinic's chief physician at the time.

The doors linking their rooms in the hospital apartment that they went on to inhabit were kept open at all times. A radio or television set was kept on most of the time, providing some sort of link with the outside world, just as it did in the cellar. Elisabeth was gradually reunited with her three teenage "upstairs" children; Lisa, Monika and Alexander. Her three cellar children began to get to know the brother and sisters they had never met. They found it difficult to call Elisabeth "Mutti" (Mum). But even more problematic was Elisabeth's relationship with her mother, Rosemarie, 66. She could not believe that her mother had not known the truth, that Rosemarie was not in league with Josef in some way.

Soon after her release she started to develop an obsession with cleanliness, showering up to 10 times a day. Her children were traumatised in different ways. The cellar children found it hard to relate to their siblings who had led normal lives. What, they asked, was the reason? The upstairs children felt guilty for having been spared.

Yet, only two years on, the family's recovery is palpable. Perhaps most remarkable is that Elisabeth has become friends with her mother.

According to Christine R, Rosemarie fled the home she shared with Fritzl more than 18 months ago, and tries to augment a meagre pension by selling homemade bags and her paintings of flowers. But nowadays she visits Elisabeth and her family at least once a week. "Whatever suspicion there was has gone," says Christine R.

By any standards, Elisabeth Fritzl's fight back to a comparatively normal life must count as a near miracle. Her struggle began in early April 2008, when she persuaded Fritzl to take their daughter, Kerstin, to hospital after she fell unconscious from acute kidney failure. Before that, she had reacted to the imprisonment by having fits and shredding her clothes and stuffing the remains in a toilet. Almost as soon as she was admitted to the clinic, doctors became highly suspicious and alerted the police.

But psychiatrists such as Dr Adelheid Kästner say that Elisabeth's second and probably most significant catharsis occurred at her father's trial almost exactly a year ago. The press and public were banned from the court to allow a videotaped recording of Elisabeth giving evidence to be played. Elisabeth crept into the court in person to witness her father's reactions. Then Josef turned round and saw her for the first time since her escape. He broke down and wept. At that moment Elisabeth knew she had won.

AN Austrian judge has ruled that cellar beast Josef Fritzl should remain in custody.
Court spokesman Franz Cutka says the decision extends Josef Fritzl's pretrial detention by a month.

The ruling was made during a routine, closed-door session required under Austrian law and will be re-evaluated in June.

The 73-year-old has been detained since April 26 for locking up his daughter Elisabeth for 24 years and fathering seven children with her.

Cops say he has confessed.


Yesterday it was revealed the incest monster wanted to have sex with his own mother.

Fritzl made a sickening confession to his lawyer as he tried to explain away his appalling crimes against his children.

He admitted the “strong woman” was a key influence in shaping his twisted psyche – as was growing up in Nazi Austria during World War II.

Adolf Hitler had been given a rapturous welcome in Fritzl’s home town of Amstetten when he visited in 1938, around the time of the cellar fiend’s third birthday.

Fritzl – who grew up to dominate two families, both above and below ground – said he took his belief in “strict discipline” and “the need to be controlled” from Hitler’s evil regime.

Rapist Fritzl, said by his neighbours to have been a brutal tyrant at home, said: “I always put a lot of value on good behaviour and respect.

“The reason for this is that I belong to an old school of thinking that just does not exist today.

“I grew up in the Nazi times and that meant the need to be controlled and the respect of authority. I suppose I took on some of these old values. It was all subconscious, of course.”

Speaking quietly and pausing frequently to choose his words carefully, Fritzl claimed rejection by father Franz and a troubled childhood had helped turn him into one of the world’s most infamous criminals.

He told how as a youngster he developed a fixation on his mother Rosa because she was “the best woman in the world” – and said he had to fight his urge to have a sexual relationship with her.

‘I was strong, I kept desires under control’

Fritzl said: “I come from a small family and grew up in a tiny flat.

“My father was somebody who was a waster, he never took responsibility and was just a loser who always cheated on my mother.

“When I was four she quite rightly threw him out the house. After that my mother and I had no contact with this man, he did not interest us. Suddenly there were only us two.

“My mother was a strong woman, she taught me discipline and control and the values of hard work.

“She sent me to a good school so I could learn a good trade and she worked really hard, and took a very difficult job to keep our heads above water.”

Describing his relationship with his mum, Fritzl added: “When I say she was hard on me, she was only as hard as was necessary.

“She was the best woman in the world. I suppose you could describe me as her man, sort of. She was the boss at home and I was the only man in the house.

“It’s complete rubbish to say my mother sexually abused me. My mother was respectable, extremely respectable. I loved her across all boundaries. I was completely and totally in awe of her. That did not mean there was anything else between us, though. There never was and there never would have been.”

Asked by lawyer Rudolf Mayer if he had ever fantasised about a relationship with his mum, he paused before answering: “Yes, probably.

“But I was a very strong man, probably as strong as my mother, and as a result I was capable to keep my desires under control.

“I became older and I managed to meet other women. I had affairs with a few girls and then a short while later I met Rosemarie.”

Calculating Fritzl chose the timid local girl to be his wife because she appeared to be the “perfect” mother for the large family he wanted.

Asked if Rosemarie had anything in common with his own mum, Fritzl snapped: “Absolutely nothing.

“She had nothing in common with my mother – perhaps a few similarities if I really think about it.

“Rosemarie was also a wonderful woman, is a wonderful woman. She is just a lot more shy and weaker than my mother. I chose her because I had a strong desire then to have lots of children. I wanted children that did not grow up like me as single children, I wanted children that always had someone else at their side to play with and to support.

“The dream of a big family was with me from when I was very small. And Rosemarie seemed the perfect mother to realise that dream. This is not a good reason to marry, but it is also true to say that I loved her and I still love her.” Even Fritzl struggled when asked to explain why he betrayed his wife and four children by climbing into a flat and raping a young nurse in 1967.

He admitted: “I do not know what drove me to do that. It’s really true I do not know why I did it. I always wanted to be a good husband and a good father.”

Fritzl spent 18 months in jail for the attack, but loyal Rosemarie took him back and they had three more children.

Fritzl made his shocking confession in the hope that detailed analysis of his behaviour would soften outrage at his actions.

But, asked how he would describe himself, Fritzl said: “On the face of it, probably as a monster.”

Josef Fritzl, the Austrian who kept his daughter Elizabeth locked in a dungeon and raped her regularly over 24 years has been begging her for money.
Fritzl, who fathered seven children by Elizabeth during her incarceration, says he needs the money to study law so he can 'defend himself', despite saying he would never appeal when he was sentenced in March of last year.

His sister-in-law Chirstine has revealed details of the letters in which he asked Elizabeth for £3,500 'just to get me started' - but his daughter has never replied to him.
Christine also reports that he also complains about conditions in his prison, complaining that he 'can't even get a cola' or special shampoo for his hair implants.
She also says that the 74-year-old still misses his wife, Rosemarie.
"Josef dreams all the time of a future with his wife but she will not have anything further to do with him," Christine told The Sun.
"She doesn't love him anymore and has changed her name."
Apparently, Rosemarie was so stressed out when she discovered her husband's monstrous behaviour, she lost two stone. She now spends much of her time on her own, painting pictures in her flat.
She had to leave the large home she had shared with Fritzl with nothing because he had more than £2 million in debts.
Christine also told how well adjusted Elizabeth is, despite her horrendous ordeal, and how she has just passed her driving test first time round.
"She is looking for a car now," says Christine.
"She likes wearing snazzy jeans and is proud of her children who all go to school and are doing well."

BANGALORE: In a year wherein the womens reservation Bill has finally materialised guaranteeing 33% reservation for them, here is more good news.

Karnataka High Court on Friday upheld the Hindu Succession Amendment Act, 2005. This means those daughters born after June 17, 1956, when the parent Hindu Succession Act came into force, can challenge proceedings with regard to their coparcenary properties. But they cannot challenge where there is a registered partition deed and when a partition has reached finality in court by a final decree from the highest court.

Son is a son until he gets a wife, however a daughter is a daughter throughout her life. A married daughter is also a co-parcener and is entitled to equal share like the son in the co-parcenary property and the marriage in no way affects her right to equal share in that property, the division Bench headed by Justice N Kumar observed. The Hindu Succession Amendment Act is curative, remedial in nature and wants to undo the injustice done to her in the last 50 years, the Bench said.

The amendment wants to give such rights from the day the Act came into force. This is the will of the people, the Bench observed.

I, Anju, am an educated girl staying in Mumbai (and a native of Bihar) was engaged to be married by an Arranged marriage to a gentleman Sandeep Sexena in Jun 2008. After my engagement, my fiancé had physical relationship with me since the day of engagement.

But in Oct 2008 , his mother and henceforth the entire family got together and plotted and and cancelled the marriage after humiliating me and my family .

After nearly committing suicide , I gathered enough strength to start legal service and sent a legal notice (because as per the Indian constitution, having physical relation on the promise of marriage amounts to Rape (article 376) ).

Later they relented and the lawyer tried to meet me in person/talk to me to have an out of court settlement .

But, later I realised she was just misguiding me , with distorted facts like how the case doesn't stand a chance as the person has already been married (which was a lie).

She also hinted in subtle tones that since she has her uncle in the highest rank in Kolkata police (where the parents of my fiancé live) , things could be moulded differently. Her uncle 'GDP AK 47' was highly decorated in early 2000s and got into an unnecessary Warfare with civilians getting drunk in a private hotel. His colleague who was decorated with him has since gone underground (with his criminal son), after his son raped a German foreigner.

Later she got abusive and started attacking me personally with statements like "you have 30 boyfriends", "you are characterless" , "you are a cheap psychopath, who needs psychiatric treatment ", "you blackmail people, extort money" etc.

I was broken down completely, alone and harboured suicidal thoughts during this traumatic harassment.

I was shocked and filed an FIR against her , and more so being a lawyer she is not supposed to talk to me or say personal things to me.

I think its time , someone spoke about this and did something against such people .

The name of the lawyer is Madhu (aka MAD) Sharam , who is apparently fighting a case for a sexually harassed victim (Female) in a Live-in relationship. She is a Bombay High Court lawyer, liar and Deceiver.

This lady lawyer is a Human Rights Association member.

How can lawyers like this abuse their positions of Power, when they are actually LIARS, DECEIVERS and CRIMINALS?

LUCKNOW: Heightened superstition coupled with blind faith in self-proclaimed godmen saw a middle-aged housewife being held hostage for three days, pinned to a charpoi, gagged and her throat and wrists slit, before she was stubbed with lit candles and beaten with a stick, simultaneously. The victim, somehow managed to escape on the pretext of going to the bathroom.
Writhing in pain, the victim approached the Lucknow police on Tuesday seeking action against the godmen and his associates who recommended treatment to get rid of evil spirits.

Talking to the media, the victim identified herself as Nisaa Bano, widow of late Qurban Ali of Akbar Nagar under Mahanagar police station circle. “I was not keeping well since my husband’s death and regular visits to the local doctor were also not yielding results when a distant relative of my sister-in-law Ferozan asked us to meet a Maulvi duo Mubeen and Anees from Mehmoodabad in Sitapur. The two were supposedly learned people and vested with powers to help people rid of evil spirits,” said Nisaa Bano.

Moaning in pain every time she moved her head or hands which led to the pulling of the skin around the slit injuries on her neck and wrists, Nisaa said she met the duo at Ferozan’s house in Laxmanpuri of Lucknow on March 10 last. The moment they arrived on the scene, they announced that they could feel the presence of an evil spirit somewhere near them and eventually pointed out towards Nisaa, saying: “They are in you”. This was enough to impress Nisaa and convince her that the duo could help her out of her ailments.

Shortly thereafter, the treatment started on the first floor room of the house where the Maulvis asked her to lie on a charpoi with her eyes closed. “Moments later when I opened my eyes, I found myself pinned to the charpoi with my limbs tightly tied to it. Every time I cried for help, the duo would try to silence her saying that it was not Nisaa but the evil spirit in her that was trying to mislead everyone. The next moment I was gagged,” Nisaa said, as she broke down inconsolably.

Next, as Nisaa puts it, all that she remembered was her neck and wrists being slit with a sharp knife, she being brutally caned with a thick wooden log and her entire body being stubbed with lighted candles as she slipped in and out of her senses. Soon she even lost track of time. Once, when she woke up to find the two Maulvis also taking a nap, she begged their associates to free her as she wanted to go to the bathroom.

“Untied, though I could barely talk because of the pain and trauma, still I gathered all my energy and dashed out of the room yelling for help. They apparently panicked and before they could gather themselves, I ran out of the house into the crowd that has gathered on hearing my cries,” Nisaa said. Later she discovered that she had been confined to the room for two days.

For the next two days, a frightened Nisaa took refuge at the house of a relative, too scared to even go out for treatment of her wounds. Finally, she did visit a private nursing home on March 13. Though Nisaa claimed that she was feeling better, the slit injuries on her neck, blue marks caused by assault with a stick and burn wounds left behind by lighted candles did stand a mute testimony to the nightmare filled with trauma, extreme pain and agony that she lived through for over 50 hours.

Colaba resident plans to appeal in HC after lower court rules against her due to lack of evidence

An 80-year-old widow has alleged that her daughter-in-law assaulted her, resulting in a broken finger, and barred her from her own Colaba flat. The widow filed a suit in March 2009, but the judgement went against her. She now plans to appeal in High Court.

Diana Demello, 81, accused her daughter-in-law Carol of throwing her out of her flat in Esperanca building at Colaba in 2004. Since then Diana has been living at Vasai with her 77-year-old maid.

Diana has four children, three settled in US, while a son Darryl is in the Merchant Navy and is married to Carol. Diana’s husband died in the 80s.

How it began

Diana said trouble began in March 2004, when her 96-year-old mother expired in Goa. When Diana returned from Goa, she was denied entry to her Colaba flat by Carol, who she alleges assaulted her, breaking a finger. “I complained to the Colaba police, but was not pleased with the manner in which they treated the case,” said Diana. “Despite being a senior citizen, I was denied justice.”


As her children were abroad, Diana decided to leave Colaba and stay at Vasai where she had already purchased a flat. “I settled there and informed Darryl about Carol’s behaviour. But the trouble continued.

Carol would phone me in the dead of the night and threaten me with dire consequences if I ever thought of returning to the Colaba flat which still belongs to me,” said Diana.

In 2007, Darryl came down briefly, and a reconciliation attempt was made. But things didn’t work out and he left.

“Later, I learnt that Carol was having an affair while still married to Darryl, who was out at sea for most of the year,” said Diana.

Court rules against her

“I put up with the mental torture till March 2009, when I filed a suit against Carol. I mentioned the torture, her illegally grabbing my flat, and the telephonic threats. But, a January 2010 order by Judge V K Shewale of City Civil Court rejected my plea citing lack of evidence,” said Diana.

Diana, who alleges that Carol misled the court, said, “Despite being a heart patient, I will appeal to HC and hope justice will prevail. I’ve even disconnected my phone in Vasai, fearing that Carol will continue threatening me.”

Diana’s son Darryl said, “I had to return as my mother, at her advanced age, cannot do the rounds of the court alone. It came as a shock to learn Carol was having an affair despite my sending Rs 1.10 lakh for her monthly expenses. I’ve appealed for annulment of our marriage, because of the torture Carol inflicted on my mother and also her affair,” said Darryl. “I hope to get justice here too,” he added.

Deb informed the judge that he had given permission to tap the phone lines of several persons associated with the case after the CID additional director-general, R.K. Mohanty, sought his nod.

Deb also said he had not informed the investigating officer of the case about the tapping of phone lines.

MUMBAI, JANUARY 27 A Republic Day visit to a Mumbai hotel turned into a nightmare for West Bengal Director General (Armed Police) R K Mohanty (57), who was allegedly detained by the staff for three hours. His offence: he reportedly protested against the serving of alcohol to foreigners on a national dry day and then spoke to the media.

In Mumbai for the day, Mohanty had decided to have dinner with his niece, Bombay HC lawyer Madhuri Sharma (45). But when the duo got to the Powai hotel, Mohanty was surprised to see a number of people being served alcohol.

He decided to try and get a drink, but was refused. ‘‘They told me only foreigners were being served alcohol, not Indians,’’ Mohanty said. ‘‘I thought the very idea of such discrimination atrocious, 60 years after Independence.” Soon, Mohanty related the incident to a TV crew that arrived at the site for a story on Republic Day.

Hotel authorities then locked the doors and asked him to stop speaking to the reporters. Mohanty said he then asked the hotel authorities to call the police if they thought he had violated a law. They reportedly refused. Finally, Mohanty himself called up his batchmate, Maharashtra DGP P S Pasricha, who sent a police team to get the group out.

MUMBAI: Just nine months into her marriage, Devanshi Bhartdwaj (22) returned to India from her matrimonial home in the UK, with tales of abuse and neglect. It took her three more months to muster the courage to lodge a complaint with the Borivli police against her non-resident Indian (NRI) husband.

Mumbai seems to have gone global with dowry harassment cases. With the premium attached to NRI alliances, it doesn't come as a surprise that when the marriage breaks, criminal cases follow. In the last few months, the Bombay high court has seen a steady stream of dowry or marital torture cases, in which the abusive husbands are mostly settled abroad. The complaints range from physical and mental abuse to incidents of forcing the wife to eat pork and uploading her "objectionable'' photographs on websites.

"Indians have a fascination for NRI boys. After a lavish wedding at some five-star hotel and spectacular dowry being given away, it's only when the girl lands in the foreign country does the reality hits her. Her dreams are soon shattered,'' said family court lawyer Madhuri Sharma, who has handled a dozen such cases in the last one year. "There have been instances where the wives are treated like bonded slaves. They are left with little alternative but to flee back to India.''

Many of the abused wives are now returning to take the help of the Indian law. According to Section 498 A of the Indian Penal Code, a woman can file a case against her husband and in-laws for subjecting her to cruelty. "The law was settled recently when the Supreme Court held that the incident of cruelty should have taken place where the woman resides, in normal circumstances, her matrimonial home,'' said former public prosecutor Satish Borulkar. "So a local police station in India can take cognisance of such complaints even if the cruelty has taken place in a foreign land.'' According to Borulkar, the Criminal Procedure Code also has a provision (Section 188) that provides for prosecution of Indian citizens, even if the offence has been committed abroad.

International dowry cases bring in its own set of problems, ranging from gathering evidence to getting the NRI spouse to face criminal action in India. "Many a times, we have taken the aid of the High Commissions of UK, the US and Australia, to execute the orders passed by the local courts here,'' said Sharma. "In extreme cases, Interpol red corner notices have been issued to bring the abusive husband to book.''
In Devanshi's case, her matrimonial life lasted barely for nine months. She married Parag Bhartdwaj in March 2008 in the city. NRI Parag left for the UK soon after, with no promises of when she should join him. Devanshi's family subsequently made arrangements so that she could join her husband in Edinburgh in Scotland. According to her complaint, when she landed in Scotland, she was not welcomed at all. Instead, she claimed, she faced neglect and physical as well as mental cruelty at the hands of Parag and his family. Finally, Devanshi alleged, her husband drove her out of their house and put her on a flight to India in December 2008. She waited for a few months before lodging a complaint under 498 A of the IPC at the Borivli police station in March 2009.
She later moved the Bombay high court, claiming police inaction. When the case came up for hearing on Monday, additional public prosecutor Aruna Pai told the HC that the police had issued notices to airports in the country with Parag's photographs and his passport number. A notice had also been sent to the Scotland police.

A division bench of Justice J N Patel and Justice Amjad Sayed, however, said it might not be enough and asked Devanshi's lawyers to include the Union ministry of external affairs as a party in the case. "The MEA has wide powers and can initiate action, including revoking his passport,'' said the judges

DINNER at Powai’s Hotel Renaissance turned into a ‘‘harassing experience’’ for West Bengal Director General of Police (Armed Police) R K Mohanty (57), who was allegedly detained by the staff for three hours after protesting the serving of alcohol to foreigners on a national dry day and then speaking to the Press about it.

In Mumbai for the day, Mohanty had decided to have dinner with his niece, Bombay High Court lawyer Madhuri Sharma (45). But when they entered the Powai hotel, Mohanty was surprised to see a number of people being served alcoholic drinks.
Intrigued—in West Bengal, dry days are observed very strictly—he decided to try and get a drink, but was refused. ‘‘They told me only foreigners were being served alcohol, not Indians,’’ Mohanty said.

The hotel later faxed Newsline a copy of a letter from the Excise Department sent six years ago, allowing foreigners to be served drinks on a dry day, but not Indians.

‘‘I have no idea whether any such rule exists,’’ said State Excise Commissioner C S Sangeet Rao.

‘‘I thought the very idea of such discrimination atrocious, 60 years after Independence,’’ said Mohanty.

Soon after he was refused the drink, a television crew arrived to do a story on how people were celebrating Republic Day. ‘‘My uncle told them he was surprised at what was going on,’’ said Sharma. ‘‘He also said that such a law was faulty and should be amended.’’

According to Mohanty and Sharma, hotel authorities then intervened and asked him to stop speaking to the reporters and ordered the cameraman to hand over his equipment. ‘‘Enraged, we decided to leave, but they wouldn’t let us go,’’ Mohanty said.

The DGP said he even told a few of the staff members who he was at this point—and warned them that they would be wrongfully detaining him if they did not let him leave. ‘‘They said they didn’t care who we were and told us and the TV crew to stay back,’’ said Sharma. ‘‘They even ordered the doorman to shut the doors.’’

Mohanty said he then asked the hotel authorities to call the police if they thought he had violated a law. They refused to. Finally, Mohanty himself called batchmate and Maharashtra DGP P S Pasricha, who sent along a police team to get the group out.

They left the hotel at 1.15 am on Friday.

‘‘On the basis of Mohanty’s statement, we have registered a complaint against the hotel for wrongful detention and criminal intimidation,’’ said Deputy Commissioner of Police (Zone X) R P Sengaonkar.

Meanwhile, the hotel claimed a Government Resolution issued in 1972 permitted the serving of alcohol to foreigners on a dry day. ‘‘We have a letter dated July 11, 2000, from then Excise Commissioner Anil Pohekar, permitting us to serve alcohol to foreigners on dry days,’’ said the hotel’s Director of Marketing Communications, Pareemeeta Gawri. ‘‘As for the TV crew, they just walked in and started filming, which is prohibited by us. We had to ask them to stop.’’

Gawri, however, denied anyone was detained. ‘‘They were there of their own will,’’ she said.

I, Anju, am an educated girl staying in Mumbai (and a native of Bihar) was engaged to be married by an Arranged marriage to a gentleman Sandeep Sexena in Jun 2008. After my engagement, my fiancé had physical relationship with me since the day of engagement.

But in Oct 2008 , his mother and henceforth the entire family got together and plotted and and cancelled the marriage after humiliating me and my family .

The last decorated Police Officer from Orissa/Andhra Pradesh was running away from the law, after colluding with his son who was accused of rape of a foreigner in Goa.

A transsexual claims his human rights have been breached because the law will not recognise him as a woman unless he divorces his wife.
Christopher Timbrell, who has changed his name to Christine, has launched a High Court fight because his marital status bars him from claiming a pension from the age of 60 like other women.
Instead Mr Timbrell, now 68, has only been entitled to claim a pension from the age of 65, like men.
The father of two wants to be formally acknowledged as a woman, without needing to get divorced, and is asking for five years' worth of backdated pension payments from the Department for Work and Pensions.
The retired chartered accountant had a sex change aged 59 but chose to remain married to his wife, Joy.
Churchgoing Mr Timbrell, from Sutton Coldfield, has gone to London's Civil Appeal Court claiming he has fallen foul of the Gender Recognition Act, which came into force in 2005.
This states that a man who has undergone gender reassignment cannot legally become female while still married to a woman - as one woman cannot be married to another.
The couple could end their marriage of 43 years and undergo a civil partnership but, as devoted Christians, they say divorce is against their religion.
If Mr Timbrell wins it could pave the way for scores of other transsexuals who remain married to their wives to get legal recognition as women.
Yesterday, Lords Justice Thorpe, Moore-Bick and Aikens heard that Mr Timbrell had known since childhood that he was 'different'.
When he retired, he said the discomfort of being a woman in a man's body grew 'unbearable' and he broke the news to his wife before having surgery in 2000.
Mr Timbrell, who has two grown-up children and two grandchildren with his wife, told the court of his 'extreme distress' at his current dilemma.
He said: 'The Government's response to my claim for a retirement pension is that I am a man; I am not. It is humiliating that the Government will not recognise this.
'Joy and I feel strongly that we do not want a divorce. We love each other and are committed to each other.'
He added: 'Divorce runs counter to both my and Joy's religious convictions. We both discussed the matter with our vicar, and he agreed with us that it would be hypocritical and probably invalid in the eyes of the Church were we to end a marriage that neither of us wished to end.'
He said he felt a civil partnership would not be 'appropriate', explaining: 'They provide a means for homosexual couples to formalise their relationship. But we are not homosexual.'
Jeremy Johnson, for the DWP, said he recognised the 'harsh choice' Mr Timbrell faced, but said it would be 'preferential treatment' for the couple both to draw pensions aged 60, compared with a mixed-gender married couple.
The three Appeal Court judges reserved their decision until a later date after yesterday's half-day hearing.

Con Artist Dr Balaji aka Krishna's another failed plot in US court to evict wife from the house.

When Meera came to realize the extent of the Deception, and relationship, she started enquiring the Bigamist , "Why me?"

The questioning led to Dr Balaji aka Krishna filing for Divorce, and harassing his troubled 'wife'. And, then filing for evicting Meera from the Shared House, by False allegations of Violence/threats of Violence against Meera.

Bigamist Dr Balaji aka Krishna filed a "Emergency order of protection" to evict Meera from the house in front of law enforcement officer with clothes and medicines only.

Dr Balaji aka Krishna claimed that he owns the house and Meera entered house with "clothes only" after the marriage. Reality is house is owned by both not only Dr Balaji aka Krishna. Meera brought her all belongings from previous house including well equipped kitchen, expensive leather furniture and many household items which Dr Balaji aka Krishna and his family enjoyed for years. Charming Dr Balaji aka Krishna had a plot to evict Meera from the house. Bring another woman to enjoy in the same house while making Meera still responsible for mortgage payment and utilities.

The con artist tried to play his tricks on lawyers and judge in a US court also.

Dr Balaji aka Krishna claims that, he is threatened to death. He and his family's life is in danger. He can't eat, cook at home, comes home at night times after 11:00 PM accompanying his son and daughter on phone till they enter their room safely. When Dr Balaji aka Krishna requests protection for minor kids, is it believable that Dr Balaji aka Krishna gets protection from his kids for life survival? Testimony was funny. He realized himself and tried to convince court one more time and said believe me, "It's not a joke!"

Dr Balaji aka Krishna says, he enters his room, locks himself, closes the door tightly, puts furniture at the door for his safety due to threat from Meera and...many... bottom line Dr Balaji aka Krishna says "I am petrified!"

At the same time he enjoys super ball party, writes e-mail to friends to defame Meera, goes to work as a normal day, his kids in school with normal routine...but he wants US court to believe that he is petrified.

"My way or the Highway!" Dr Balaji aka Krishna is known for that. He is in court for some or the other reasons in US court for more than a decade. While there is not a single incidence against Meera in US court on domestic violence or any other matter. The expert con artist tried to fool US court to evict Meera with clothes only.

Did the False allegations work?

NO, the case was thrown out of the Court.

Not only the case was closed but Dr Balaji aka Krishna's lawyer informed US court that his lawyer will not represent him for future court proceedings.
